Just days before the trial commenced, Elon Musk sought to settle his lawsuit against OpenAI, which accuses the company—under Sam Altman’s leadership—of abandoning its founding nonprofit mission to develop AI for humanity’s benefit.

According to a Sunday court filing from OpenAI, Musk messaged OpenAI President Greg Brockman two days prior to the trial to “gauge interest” in a potential settlement. Brockman responded by proposing that both sides drop their claims.

Musk rejected the offer and escalated his rhetoric, leading the court to consider Brockman’s testimony about the exchange as evidence of Musk’s alleged motives in pursuing litigation.

In his reply to Brockman, Musk wrote:

“By the end of this week, you and Sam will be the most hated men in America. If you insist, so it will be.”
