An AIDS activist group has filed a lawsuit against the Trump administration, alleging it failed to disclose a critical research and development agreement tied to a $1.3 billion settlement with Gilead Sciences over patents for HIV prevention drugs.

The settlement resolved a six-year legal dispute initiated by the previous Trump administration after the Centers for Disease Control and Prevention (CDC) accused Gilead of infringing its patent rights. The CDC had contributed to academic research that later underpinned the development of two widely used HIV medications: Truvada and Descovy.

The administration had alleged that Gilead:

  • Ignored contributions from CDC scientists,
  • Overstated its role in developing HIV prevention drugs, and
  • Refused to sign a licensing agreement despite multiple attempts,

while profiting hundreds of millions of dollars from taxpayer-funded research.
