Mass Exodus at the Justice Department Under Trump
Thousands of experienced attorneys and staff have left the U.S. Department of Justice (DOJ) since Donald Trump returned to the White House in 2025. Many cite ethical concerns over being forced to pursue politically motivated prosecutions as the primary reason for their departure.

Young added that the DOJ is losing countless lawyers, the rule of law is being eroded, and the department’s reputation has "really disintegrated."
Staffing Crisis Leaves DOJ Crippled
Before Trump’s second term began, the DOJ employed an estimated 10,000 attorneys. By September 2025, that number had nearly halved. According to Justice Connection, an advocacy group tracking departures, approximately 5,500 employees—including attorneys, support staff, and administrators—had left the agency. Departures occurred through:
- Voluntary resignations
- Acceptance of buyout offers from the Trump administration
- Terminations
The DOJ has struggled to replace these experienced professionals, leading to severe operational disruptions.
Immigration Court Backlog Reaches Record High
The staffing shortage has had devastating consequences, particularly in the immigration court system. As of February 28, 2026, the Transactional Records Access Clearinghouse (TRAC) reported a backlog of more than 3.3 million pending immigration cases. This means the lives of over three million individuals remain in legal limbo, awaiting decisions that will determine their future in the United States.
Legal Community Raises Alarm Over DOJ Politicization
The DOJ’s shift toward a hard-right, MAGA-aligned agenda has alarmed legal experts. Critics argue that the agency’s increasing politicization has undermined public confidence in the U.S. legal system, raising concerns about fairness, impartiality, and the erosion of long-standing legal norms.
