今回の起訴に関する詳細な内容は直ちには公開されていないが、Fox Newsやニューヨーク・タイムズなどのメディアが報じたところによると、起訴の根拠はコミー氏がSNSに投稿した貝殻で「8647」という数字を表現したアート作品に関連しているという。一部の共和党議員は当時、この投稿をトランプ氏への脅迫と解釈していた。
過去の経緯として、司法省は昨年、コミー氏が2020年に議会に対して虚偽の証言を行ったとして起訴を試みたが、その裁判は頓挫していた。
